GENERAL INFORMATION
You must read these terms and conditions ("terms") and agree to them before creating a Cascade account or using the Cascade website or mobile app. If you do not agree with these terms, you may not use Cascade. In these terms, "we", "us", "our", or "Cascade" refers to Cascade LLC, a United States company, and "content" and "your content" refers to any information you submit or store using Cascade services, including account information, deck information, inventory information, card list information, and support messages.
CHANGES TO TERMS
Cascade reserves the right to modify these terms for any reason, at any time. Users will be notified by posting such changed or updated terms on this page. Your continued use of Cascade after any changes constitutes acceptance of the new terms. If you don't agree to the new terms, you may delete your account and stop using Cascade.
PROHIBITED USE OF CASCADE
- Cascade is for people ages 13 and up. You may not use Cascade if you are under the age of 13. If you believe someone under 13 is using Cascade, please contact us immediately.
- Cascade is not for advertising or sales. Cascade is about playing Magic: The Gathering. Cascade does not facilitate sales or trades between players.
- You may not use Cascade to sell, offer, advertise, or trade any products or services, including Magic cards.
- You may not post content purely for the purpose of advertising your clan, guild, team, club, store, company, or enterprise.
- You may not scrape Cascade or solicit information from Cascade users for the purposes of recruitment, head-hunting, or job boards.
- You may not post political advertisements or political statements on Cascade.
- You may not use Cascade to recruit or advertise for any uniformed service, corps, or military program.
- Cascade is not a platform for crime or deception.
- You may not host pirated or stolen content on Cascade, you may only post content that you own or created or have the license to use.
- You may not use Cascade to offer counterfeit gaming materials or instruct others on how to create them.
- You may not impersonate anyone on Cascade.
- You may not use Cascade to distribute computer malware.
- You may not interfere with Cascade operation.
- You may not attempt to gain access to another user's account.
- You may not attempt to disrupt or tamper with Cascade servers or services.
- You may not place undue burden on Cascade through the use of automated means.
- You will maintain ownership of your Cascade account. Your Cascade account belongs to you alone, and it is not shareable or transferable.
- You may not register a Cascade account with the intent to share access to it with other parties or make it intentionally insecure, open, or "generic".
- You may not sell, trade, or transfer ownership of your Cascade account to another party.
INTELLECTUAL PROPERTY
The Cascade website, mobile app, and all content, features, and functionality (including but not limited to software, text, graphics, logos, and design) are owned by or licensed to Cascade LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use Cascade for your own personal, non-commercial use.
Wizards of the Coast, Magic: The Gathering, and their logos are trademarks of Wizards of the Coast LLC. The literal and graphical information presented on Cascade about Magic: The Gathering, including card images, mana symbols, and set symbols, is copyright Wizards of the Coast LLC. Cascade is unofficial Fan Content permitted under the Wizards of the Coast Fan Content Policy. Cascade is not affiliated with, endorsed, sponsored, or specifically approved by Wizards of the Coast LLC.
Card data is provided by Scryfall. Price data is provided by TCGPlayer for informational purposes only.
USER CONTENT
You retain ownership of any content you create on Cascade, including deck lists, inventory data, lists, and other user-submitted information. By submitting content to Cascade, you grant Cascade LLC a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving Cascade.
If you choose to share content publicly (such as sharing a deck or list), that content may be viewed by other users. You may revoke public sharing at any time through your account settings.
You are solely responsible for the content you submit to Cascade. You represent that you have the right to submit such content and that it does not violate any third party's intellectual property or other rights.
CANCELLATION OF SERVICES
If you fail to adhere to these guidelines for acceptable use, we may (but do not have to) take any of the following actions:
- We may issue you a warning.
- We may suspend or delete your account.
- We may restrict your future access to our services.
- We may report any illegal activities to your internet service provider or appropriate law enforcement authorities.
Cascade reserves the right to suspend or terminate your account at any time, for any reason, with or without notice. Cascade is not liable for any damages resulting from suspension or termination of your account.
MEMBERSHIPS AND SUBSCRIPTIONS
Cascade offers optional paid subscriptions that provide access to additional features. By purchasing a subscription, you agree to the following:
- Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date.
- Billing: You will be charged at the beginning of each billing period. For free trial offers, you will not be charged until the trial period ends.
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid period.
- Refunds: Subscription fees are generally non-refundable. Purchases made through the Apple App Store are subject to Apple's refund policy. Purchases made through the web are processed by Stripe and are non-refundable.
- Price changes: Cascade reserves the right to change subscription pricing. Existing subscribers will be notified of price changes before their next billing period.
DISCLAIMER OF WARRANTIES
Cascade is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Cascade does not warrant that the service will be uninterrupted, secure, or error-free, or that any defects will be corrected. Cascade may have downtime, outages, or periods of slow activity.
Price data is for informational purposes only. Cascade may include information about the price of third-party products or cards. Absolutely no guarantees are made for this information. See stores for final prices.
Card legality is provided for informational purposes only. Cascade may include information about the tournament legality of cards. Absolutely no guarantees are made for this information. Please contact a local judge or Wizards of the Coast customer service for help with evaluating your deck for sanctioned events.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Cascade LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of Cascade, whether based on warranty, contract, tort (including negligence), or any other legal theory.
In no event shall Cascade LLC's total liability to you for all claims arising out of or relating to these terms or your use of Cascade exceed the amount you have paid to Cascade in the twelve (12) months prior to the event giving rise to the claim, or fifty U.S. dollars (US $50), whichever is greater.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Cascade LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of Cascade, your violation of these terms, or your violation of any rights of a third party.
COPYRIGHT INFRINGEMENT
If you believe that content on Cascade infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing the following information to our designated copyright agent:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and its location on Cascade.
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

DISPUTE RESOLUTION
Governing law: These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
Informal resolution: Before filing any formal dispute, you agree to first contact Cascade via our contact page and attempt to resolve the dispute informally for at least thirty (30) days.
Binding arbitration: If an informal resolution is not reached, any dispute, controversy, or claim arising out of or relating to these terms or your use of Cascade shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator, and the arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Cascade LLC.
Jury trial waiver: You and Cascade LLC waive any right to a jury trial in connection with any dispute arising out of or relating to these terms.
GENERAL PROVISIONS
If any provision of these terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
Cascade's failure to enforce any provision of these terms shall not be considered a waiver of that provision or the right to enforce it in the future.
These terms constitute the entire agreement between you and Cascade LLC regarding your use of Cascade and supersede any prior agreements.
